None-Returnable Items Policy

Applies To: All purchases made from Dynagem, including retail and trade transactions.


1. Purpose

This policy outlines the conditions under which certain product categories are sold on a final sale basis. These items are non-returnable, non-refundable, and non-exchangeable once dispatched or collected, except where proven faulty or not as described, in accordance with applicable law.

2. Scope of Non-Returnable Items

Due to their technical, chemical, or precision nature, the following items are strictly excluded from return or refund:

  • Gold and precious metal testing equipment, including electronic, XRF, and acid-based testing systems.
  • Diamond, gemstone, and moissanite testers.
  • Gemological tools, instruments, and laboratory equipment.
  • Jewellery and gemstone photography, lighting, and studio equipment.
  • Jewellery and gemstone scales, balances, and other weighing or measuring devices.
  • Consumables and chemical-based products used in testing or calibration.
  • Special-order, customised, or personalised tools or accessories.

These products are sold for professional or controlled use and are subject to strict contamination, calibration, and tamper restrictions.

3. Reasons for Non-Returnability

  1. Calibration Integrity: Once dispatched, calibrated or sensor-based instruments cannot be verified as unused or uncompromised.
  2. Chemical Handling: Testing fluids, acids, and similar substances are classified as hazardous and cannot re-enter supply chains.
  3. Hygiene and Contamination: Equipment that comes into contact with metals, gemstones, or testing media may pose contamination risks.
  4. Customisation and Specification: Certain tools and devices are configured to order and cannot be resold or repurposed.

For these reasons, no returns or exchanges can be accepted once an order has been processed and dispatched.

4. Faulty or Misdescribed Goods

This policy does not limit statutory rights under the Consumer Rights Act 2015 or equivalent trade laws. If an item is received faulty, damaged, or not as described, the Buyer must notify the Seller in writing within 7 calendar days of receipt and provide supporting evidence (such as photographs or video).

Where a fault is verified:

  • If the defect existed at the time of supply, the Seller will offer a repair, replacement, or refund at its discretion.
  • If the issue arises from misuse, improper setup, or unauthorised modification, no compensation will be issued.

5. Retail (Consumer) Purchases

  • Returns are not accepted for items listed in Section 2 unless faulty or misdescribed.
  • The Buyer acknowledges understanding of the product’s intended purpose before purchase.
  • Consumer statutory rights under UK law remain unaffected.

6. Trade (B2B) Purchases

  • All sales of the listed items are final and made without right of return, unless a manufacturing defect is proven at dispatch.
  • The Buyer is responsible for ensuring compatibility, suitability, and correct application before ordering.
  • The Seller accepts no liability for consequential losses or calibration discrepancies arising from misuse or improper operation.

7. Conditions of Sale

By completing a purchase of any item covered under this policy, the Buyer (whether retail or trade) acknowledges and agrees that:

  • The item is supplied on a non-returnable, non-refundable basis.
  • Product suitability and technical requirements have been confirmed before the order.
  • The Seller has made this policy visible and accessible before the point of sale.

8. Legal Enforceability

This Non-Returnable Items Policy forms an integral part of the Seller’s Terms and Conditions of Sale. All transactions involving the products specified herein are governed by UK law and subject to the jurisdiction of UK courts. Nothing in this policy affects the Buyer’s statutory rights where applicable.
